Terms of Service

Quotes & Contracts

Quotes provided to prospects will be honored for 30 days. A new quote will then be provided upon request.  Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request.

Any work or changes requested after the contract has been signed, will need to be quoted for separately.

 

Start Work

We will not start work until we have agreed and signed off on the job, received all relevant information to begin and complete the project.  This includes, but is not limited to,

  • Relevant account access (website, domain name, hosting, 3rd party services)
  • Branding Files & Guidelines (logo, colours)
  • Photos & Artwork (uploaded to shared Google Drive)
  • Text & Copy (Company information, bio’s, product and service descriptions)
  • Confirmation of down payment as per contract

Project time frames are generally 4~8 weeks.  This time starts after the above information has been received in full, to the best of everyone’s ability, and will be confirmed in writing.  This will vary depending on a number of factors, including, but not limited to, complexity, 3rd parties, incomplete information being discovered, back-and-forth for checks, updates, and sign-offs.

 

Charges & Fees

Unless pre-arrangements have been made; All new web design projects that are $1,000.00 or less require full payment upon contract signing.  Projects where the total cost is over $1,000.00 will be split into two payments. An initial 50% deposit will be due at contract signing.  The remaining 50% balance will be due after acceptance of the completed web development project, 30 days or before from date of final invoice. 

Late payments past the due date will incur an administration fee of $30 inc GST and 15% APR on the outstanding amount.  Any payments past 90 days, we reserve the right to engage a 3rd party and add the cost of and pursue expenses.

Payments

SimpleStuff Limited accepts payments via direct debit into our NZ bank account, via our Paypal.com account, or via a TransferWise.com account we provide to you upon request, in your currency.  Please ensure time for the payment to clear before the due date if using a method that will take longer than 24 hours.

 

Non-Payment & Disputes

If for any reason there is an issue in regard to work or payment, we will endeavor to resolve it in an amicable way.  If communication via conversation has broken down, we will provide, and or require written explanation of the issue at hand.  A written record of conversations will reduce misunderstandings and speed up resolutions.

SimpleStuff Limited retains the right to suspend or redirect domain names, website hosting, email services, content, where full payment has not been made.

In the case of domain names, if payment is not made on time, and the domain expires, there is no guarantee we can recover the domain.

Your project will not be fully released to you or uploaded until full payment is received.  Any payments past 90 days, we reserve the right to engage a 3rd party and add the cost of and pursue expenses.

Refunds

SimpleStuff Limited requires a deposit before we begin work on any project.  A request to terminate services must be presented to SimpleStuff Limited in writing.  If we fail to complete your project within 120 days of the start date AND you have turned in all content, images and information requested by us, you will receive a refund within 30 days of your written request.  An administration fee maybe charged if services have been deployed.  We reserve the right to not refund expenses provided by 3rd parties where services have been rendered, for example, and not limited to, domain name purchase, where ownership can be transferred.

 

Acceptance

Please note that by submitting your down-payment for our services you are agreeing to all of our terms of service as written here.  SimpleStuff Limited reserves the right to change or update these terms at any time without prior notice.

 

Quality of Service

We endeavor to provide the best quality of service we can.  At times, things may go wrong.  When brought to our attention we will resolve them as soon as we can. “Act’s of God” or “unexpected acts of mass hysteria” on the internet, are out of our control.

We employ best practices for security and hardening WordPress where possible.  We are not responsible for bad actors and the results they achieve.  We will correct issues as soon as we can, and look into stopping it becoming a repeat.

If we have made a mistake, we will correct the issue, and if required, decide the best way to compensate for any issues created.

Our service providers may also have issues at time, and we will follow up with them when we are aware.  If your website experiences an unexpected increase in traffic, it may not perform as expected.  Please be aware that large amounts of visitors will require more resources, that will incur additional costs.  Please discuss options with us, if you are are aware of an upcoming promotion, or if this happens on a regular basis.

We will asses possible charges or refunds at the time of the event, after circumstances have been identified.
